Article 71. Modernization Assumed by Owners

(1) The association’s administrator is bound to accept the execution of interventions or works when the following conditions are met:
a) a group of at least 3 owners proposes the design for the execution of the works and assumes all the expenses related to the implementation of the project;
b) the intervention or work does not contravene legislation, especially not violating the requirements regarding construction quality;
c) the intervention or work has public utility and does not affect the architectural decor of the condominium;
d) following the receipt of the request as per letter a) and the transmission of the request and its annexes to all owners in the condominium, stating that the expenses for the execution of the project are borne exclusively by the owners who have assumed this expense in writing, within one month from the transmission of the request, neither the owners nor the association’s administrator have received objections to the execution of the project from more than 3 owners.

(2) If objections to the execution of the project have been received from 4 or more owners, the association’s administrator is bound to convene the general meeting to decide on the permission of the proposed project or opposition to the project.

(3) The final decision on the proposal is made by the general meeting according to Article 37, paragraph (1).

(4) In the case of carrying out interventions or works according to the procedures laid down in paragraph (1), the related expenses are borne only by the owners who have assumed in writing the obligation to participate in the project. Other owners are exempted from any expenses related to the project, even if they voted for permission of the proposed project as per paragraph (3).

(5) The interventions or works carried out according to this Article are done by the association or under the association’s supervision. They become definitively common parts and are not subject to separation or reimbursement.
