Article 327. Void and avoidable juridical acts
(1) A juridical act is void if the nullity sanctions the violation of a legal provision that protects a general interest (absolute nullity).
(2) A juridical act is avoidable if the nullity sanctions the violation of a legal provision that protects a private interest (relative nullity).
(3) Where neither the nature of the nullity is explicitly provided for nor is the nature of the protected interest apparent, a juridical act is avoidable.
(4) Unless the law provides otherwise, the nullity of a bilateral or multilateral juridical act may also be established or declared by the parties’ agreement.
(5) The parties’ agreement may not establish or exclude grounds of nullity.
