Article 13. Condominium ownership

(1) Exclusive ownership over the unit and the share of the common ownership form an undivided unit and may not be transferred or encumbered separately. In this case, the other condominium owners do not hold a preemption right provided for by Article 552 of the Civil Code no. 1107/2002.
(2) Upon change of the holder of the exclusive ownership over the unit, the share in the common ownership also passes onto the new owner by operation of law, even if this consequence was not explicitly stipulated.
(3) A condominium owner may not claim the separation in kind of the share held by it in the common ownership.
