Article 51. Claim of Undue Payments
(1) A condominium owner is not required to challenge an invoice or other payment notice sent by the association, manager, or an intermediated service provider if the claimed payment is not actually owed by it. In the event of a dispute, the owner is entitled to claim the lack of any legal basis of the payment claimed from it, both through legal action and as a defense.
(2) A condominium owner is only obligated to pay the amounts due according to this law.
(3) Voluntary payment by a condominium owner of a claimed payment does not render the payment actually due, even if it knew or could have known of its unjustified nature. The owner may claim reimbursement of such payment or treat it as an advance for future payments.
(4) An owner is entitled to notify the sender of invoices or other payment notices about the incorrect nature of amounts claimed from it at any time, even if it has already paid such amount. The notification must be handled by the [recepient] within one month.
