Article 1662. Scope of Application
(1) Any personal security provided by a consumer security provider in favor of a creditor that is a business is subject to the provisions of this Section and, additionally, to the provisions of sections 1, 2, and 4.
(2) A personal security is not subject to the provisions of this Section if the security provider, being a natural person, is a member, associate, shareholder, or administrator of the debtor which is a legal entity, or has any other means to exercise substantial influence upon the debtor.
(3) If it is stipulated that the personal security is independent, such a stipulation is subject to absolute nullity, and the security is a suretyship, provided the other requirements for validity of a suretyship are met.
(4) Any term that contravenes the provisions of Sections 1, 2, 4, and this Section to the detriment of the consumer who is a surety is subject to absolute nullity.
