Article 83. Property Management Contract
(1) A property management contract is concluded in writing. Failure to conclude it in writing results in the nullity of the property management contract.
(2) A property management contract must include at least:
a) the scope of property management services provided by the manager, specifying the property management services mentioned in Article 82, paragraph (1) that the manager does not provide under the said contract and which remain the responsibility of the association;
b) the amount of payments for the property management services subject to the contract or the exact method for determining them;
c) performance indicators in the execution of property management services;
d) the duration of the contract (minimum term is 1 year, and maximum term – 7 years).
(3) The property management services laid down in Article 82 paragraph (1) fall under the responsibility of the manager unless the property management contract excludes them. However, the obligation laid down in Article 82 paragraph (1) subparagraph a) may not be excluded from the subject matter of the property management contract or limited in any other way.
(4) In the property management contract between the association and the manager, the charge of payments by the manager from the owners who are members of this association is prohibited. The manager who has a property management contract with the association collects all payments due under the contract only from the association.
(5) If the manager notifies the association about the decision to terminate the property management contract before its term, according to the law or contract, the termination takes legal effect after a period of 6 months from the notification to the association, unless the general meeting has approved the immediate effect of the termination based on the manager’s notification.
(6) In the event of termination, for any reason, of the property management contract, the manager is bound to hand over to the association, and at the association’s request, to the new manager all the necessary or useful information and documents for taking over the property management services. Such information and documents must be transmitted no later than 3 days before the termination of the property management contract.
