Article 87. Transformation of Associations of Privatized Housing Owners, Housing Cooperatives, and Housing Construction Cooperatives
(1) Within 18 months from the entry into force of this law, associations of owners of privatized homes/apartments, housing cooperatives, and housing construction cooperatives shall reorganize by transforming into condominium owners’ associations.
(2) The legal entities laid down in paragraph (1), the immovable property managed by them, and the unit owners in these properties are subject to the regime provided by this law from the date of entry into force of this law, even if they have not yet transformed according to paragraph (1). The charters or other founding documents of these legal entities, as well as their regulations, apply to the extent that they do not contradict this law.
(3) The decision on the transformation of the legal entity laid down in paragraph (1) and the approval of the association’s charter is made by its administrator, without the resolution of the general assembly of its members (participants).
(4) The decision provided for in paragraph (3) constitutes a ground for the ex-officio registration of the transformation, the change in the legal form of organization, and the full and abbreviated name of the association in the state register of legal entities. The transformation is registered:
a) without publication in the Monitorul Oficial al Republicii Moldova;
b) without paying a registration fee, provided that the application for registration of the transformation has been submitted within the period provided in paragraph (1).
(5) If the legal entity mentioned in paragraph (1) is entered in the register of immovable property as the owner of the building (chapter B), its data will be removed, and the entry “condominium” will be made.
(6) Article 86 paragraphs (4)-(9) applies correspondingly to the legal entities laid down in paragraph (1).
(7) Garage construction cooperatives, garage owners’ associations, and other similar legal forms of organization may transform into condominium owners’ associations according to the current legislation and may establish a condominium under the conditions of this law.
