Article 93. Protection of Third-Party Owners’ Rights

(1) If, at the date of entry into force of this Chapter, a person holds exclusive ownership over a building or other construction, in which no isolated rooms with distinct cadastral numbers are formed (electric substations and other objects from the energy and telecommunications complex; thermal heating networks, water supply, and sewerage up to the demarcation points of the networks and internal installations in the condominium; air-raid shelters, radiation shelters, and other objects with strategic purpose; garages, etc.), located on the land of the condominium declared under Article 88 paragraph (1) and it is not possible to separate the land portion corresponding to their building under Law No. 354/2004 on the Formation of Immovable Property, such person retains its ownership, and the construction does not form part of the condominium.

(2) The legal right of superficies over the land of the owner of the construction that is not part of the condominium, established by Law No. 1125/2002 for the implementation of the Civil Code of the Republic of Moldova, remains unaffected.
