Article 105. Modification of Related Normative Acts
(1) Upon the entry into force of this law, the following normative acts are amended as follows:
I. Chapter III and Annexes No. 4 and 5 of the Law on the Privatization of the Housing Fund No. 1324/1993 (republished in the Official Monitor of the Republic of Moldova, special edition of June 27, 2006), with subsequent amendments, are repealed.
II. The Law on Condominium in the Housing Fund No. 913/2000 (Official Monitor of the Republic of Moldova, 2000, Nos. 130–132, Art. 915), with subsequent amendments, is repealed, except for Articles 8 and 9.
III. Article 11 of the Enforcement Code of the Republic of Moldova No. 443/2004 (republished in the Official Monitor of the Republic of Moldova, 2010, Nos. 214–220, Art. 704), with subsequent amendments, is supplemented with subparagraph s) with the following content:
„s) the minutes of the general meeting of the condominium owners’ association under the conditions and to the extent provided for in Article 59 of Law No. 187/2022 on Condominium.”
IV. Article 12 of Law No. 163/2010 on the Authorization of Construction Works (Official Monitor of the Republic of Moldova, 2010, Nos. 155–158, Art. 549), with subsequent amendments, is supplemented with paragraph (22) with the following content:
„(22) References in this law to the owner include also:
a) the condominium owners’ association whose members are co-owners or superficiaries of the land/property;
b) the superficiary of the land.”
(2) Upon the entry into force of Chapter VII of this law, Articles 8 and 9 of the Law on Condominium in the Housing Fund No. 913/2000 (Official Monitor of the Republic of Moldova, 2000, Nos. 130–132, Art. 915) are repealed. Applications submitted according to Articles 8 and 9 until the entry into force of Chapter VII are to be resolved according to Articles 8 and 9 and the legislation applicable to the application.
