Article 1088. Promise to cause a third party to act
(1) A contracting party (promissor) which has assumed the obligation to cause a third party to conclude a juridical act or to ratify it or making another performance must repair the loss caused to the other party if it failed to so cause the third party. The promissor is liable even where the failure is excused.
(2) A promissor is not liable for the manner in which the third party has performed its own obligation unless the promissor has guaranteed the performance under the provisions of suretyship and other personal security interests.
