Article 490. Presumption of ownership

(1) A possessor is presumed owner of the property until proven otherwise. This presumption does not apply where, under the law, ownership is acquired by registration in a public register nor in respect of a former possessor whose movable property was stolen, lost or otherwise got out of its possession without its consent, save for money and bearer securities.
(2) Until proven otherwise, a former possessor is presumed to have been the owner of the property during the entire period it possessed it.
(3) In case of indirect possession, the presumptions provided by this Article are for the benefit of the owner-possessor.
