Article 1653. Manifestly abusive or fraudulent demand

(1) A security provider is obliged to refuse performance based on the demand if it is unequivocally proven by evidence available at the time of the examination of the demand that the demand is manifestly abusive or fraudulent. The obligation to refuse arises regardless of whether the debtor has presented the prohibition order referred to in paras. (2) and (3).
(2) In the case of the request referred to in para. (1), the debtor may request a court to issue an order prohibiting:
a) performance by the security provider; and
b) issuance or utilisation of a demand for performance by the creditor.
(3) Notwithstanding the Civil Procedure Code, the order prohibiting the security provider’s performance takes effect from the date of issuance.
