Article 1828. Non-Discrimination
(1) The use of gender (including pregnancy or maternity) as a factor in the calculation of premiums and benefits shall not result in differences in individuals’ premiums and benefits insurance law provides otherwise.
(2) Race, color, nationality, ethnic origin, tongue, religion or convictions, opinions or political affiliations shall not be factors resulting in differences in individuals’ premiums and benefits.
(3) If an insurance contract contains terms in breach of paras. (1) or (2), such terms shall, by operation of law, be replaced by non-discriminatory terms. Any term to the contrary is void.
(4) If an insurance contract contains terms in breach of paras. (1) or (2), the policyholder shall be entitled to terminate the insurance. Notice of termination shall be given to the insurer in writing within 2 months after the breach becomes known to the policyholder.
