Article 1847. Failure to pay the premium before the beginning of the insurance period
(1) When the insurance contract provides a clause that payment of the premium or its first tranche is a condition of effectiveness of the contract or of the beginning of insurance period, that clause may be relied upon by the insurer only if:
a) it is included in the insurance contract using clear language and warning the applicant that he lacks cover until the premium is paid, and
b) payment was not made within 3 business days from the due date.
(2) If the conditions set out in para.(1) are met, the insurance period starts to run only from the time when the premium or the first tranche of the premium is paid, unless the insurance was terminated under Article 1849.
