Article 1851. Notice of insured event
(1) The occurrence of an insured event shall be notified to the insurer by the policyholder, the insured or the beneficiary, as appropriate, provided that the person obliged to give notice was or should have been aware of the existence of the insurance cover and of the occurrence of the insured event. Notice by another person shall be effective.
(2) If the contract requires notice to be given within a stated period of time, such time shall be reasonable. The duty to give notice is treated as duly discharge if the notice is dispatch within the deadline.
(3) The insurer may not rely on a contract term under which it is totally or partially relieved of its obligation if the duty to give notice has not been properly discharged unless to the extent that, such failure to give proper notice, seriously prejudice the interests of the insurer.
