Article 1879. Claims Exceeding the Sum Insured

(1) If the total payments due to several victims exceed the sum insured, the payments shall be reduced proportionately.
(2) An insurer who, being unaware of the existence of other victims, has in good faith paid out the indemnity to the victims known to it, shall be liable to the other victims up to the balance of the sum insured.
