Article 91. Condominium Owners’ Right to Extend the Land Area

(1) If, based on Article 88 paragraph (2) or Article 89 paragraph (2), the land has ceased to be the property of the state or administrative-territorial unit, and the building in the respective condominium has a residential purpose, the association is entitled to request from the state or, as appropriate, from the administrative-territorial unit, the separation of one or more areas of adjacent land, belonging to the state or, as appropriate, the administrative-territorial unit, and their transfer, free of charge, through a simple written handover document, for the use of the condominium owners, including it within the boundaries of the condominium land.

(2) The right set out in paragraph (1) exists only to the extent that the extension of the land is necessary to provide the condominium with an unbuilt area which, according to the nature or purpose of the building, ensures the proper service and operation of the building, in accordance with the legislation and urban planning documentation.

(3) In the event of a violation of the right provided for in paragraph (1), the association, as well as any owner in the condominium, may request the court, within the period provided for in paragraph (4), to extend the land under paragraph (1) and (2) by virtue of the judgment.

(4) The right of extension provided for in this Article expires 10 years from the entry into force of this Chapter.
