Article 2579. Determination of the Content of Foreign Law

(1) The content of a foreign law is established in accordance with its official interpretation and the practice of its application in that foreign state.

(2) To determine the content of the rules of foreign law, a court may seek assistance and clarifications from the Ministry of Justice of the Republic of Moldova, other competent authorities or organizations in the Republic of Moldova and abroad, request the opinion of an expert, or use another appropriate method.

(3) The parties to a proceeding may submit documents that confirm the content of the rules of a foreign law invoked to support their claims or defenses, or may assist the court in other ways in determining the content of these rules.

(4) In case of private legal relationships to which a business is a party, the obligation to provide information regarding the content of foreign law may be imposed by the court on the business.

(5) If it is impossible to establish the content of the foreign law within a reasonable time, despite taking the necessary measures in accordance with the provisions of this Article, the law of the Republic of Moldova shall apply.
